TERMS AND CONDITIONS

1. PARTIES AND AGREEMENT

Bombay Club and Resorts OÜ, registration number 14045680, with its registered address at Rataskaevu 5, 10123 Tallinn, Estonia (the “Operator”), is a company incorporated in Estonia and is the Operator of the Platform.

The Operator is licensed in Estonia and regulated by the Estonian Tax and Customs Board. It provides games under the perpetual operating licence for organising games of chance under; Activity license no. HKT000031, operating permit no. HKL000404.

A Client is a private individual aged 21 or over, who has registered and been accepted as an active registrant by the Operator.

The games offered by the Operator are games of chance: casino, live casino, jackpot games, and other games occasionally made available on the Platform.

The Player Account on the Platform is intended for managing gambling-related spending, refunds, and winnings. It must only be used for gaming services. The Operator reserves the right to restrict payments to the Player Account at any time for security purposes. By using the Operator's services under these Terms and Conditions, the Client also agrees to the Operator's Privacy Policy.

2. PLAYER ACCOUNT

Deposits, withdrawals, and registration on the Platform are managed via the YoloWallet user account. Clients must verify their identity: (a) by physically visiting a casino reception for face-to-face verification by casino staff; or (b) through remote identification verification services, such as the service provider Sumsub Tech Ltd..

Deposits must be made from a personal bank account held in the name of the Player, via YoloWallet to the Platform (Player Account). The Operator will open the Player Account upon receiving the deposit, provided the Client meets the Terms and Conditions.

The Client confirms that:

The Client must ensure compliance with laws applicable in their jurisdiction. Clients located in countries where online gambling is prohibited must not use the Operator's services.

The Operator may at any time request additional documentation (e.g. ID or proof of address).

Failure to provide accurate or sufficient documents may result in account suspension or closure.

The Client consents to the collection, processing, and storage of their personal data in the Operator's customer register in accordance with applicable law and licence obligations.

The Operator reserves the right to restrict payments to the Player Account at any time for security or legal reasons.

The Operator does not issue individual receipts or confirmations for account transactions. All entries are recorded electronically.

The Client is responsible for keeping login credentials confidential. The Operator is not liable for losses arising from third-party access due to disclosure of credentials.

The Operator does not disclose Player Account data via live chat.

3. DEPOSITS

Clients may participate in games only if they have sufficient funds in their Player Account.

Details and methods for funding the Player Account are listed separately on the Platform. Deposits must be made in accepted currencies, and from the Client’s personal account. The minimum deposit is €10. Transfers to the Platform are only accepted through valid deposits via YoloWallet.

The Client is responsible for any charges debited by banks or other payment service providers in connection with payments to or from the Operator's account.

If monthly deposits or withdrawals exceed €2000, the Operator must conduct further identity verifications and apply additional customer due diligence measures. It may do so at lower thresholds if deemed necessary.

The Operator is not liable for any currency conversion or transaction fees arising from deposits made in currencies other than euros.

All transactions are monitored to prevent money laundering and terrorism financing.

Client funds are reported and held separately from the Operator's operational funds. No interest is paid on funds held by the Operator on behalf of the Client.

4. BONUSES

Deposit bonuses, free bets, risk-free bets, free spins and any other bonuses may only be claimed and used once per person/account, household, address, device, email, credit card number, IP address or shared network (e.g. university, office, internet cafe).

Welcome offers (including enhanced odds and other first-time bonuses) may also only be claimed once under the same conditions.

The Operator reserves the right to close Player Accounts and void bonuses in the event of abuse or fraud.

5. WITHDRAWALS

Game winnings are automatically visible in the Player Account.

Information on how to withdraw funds from the Player Account to the Client's personal account is provided on the Platform.

Withdrawals are only permitted to the Client's YoloWallet user account, and subsequently to their personal account using the same method as the deposit. Withdrawals to third-party accounts are prohibited.

The Operator may request further ID documents to confirm account ownership before processing a withdrawal.

The Operator may require a one-time wagering of the deposit amount before approving any withdrawal.

All withdrawals are subject to AML/CTF checks and may take additional time.

Withdrawals are typically processed within 48 hours of the request. Delays may occur due to regulatory obligations, e.g. in the event of account closure.

The Operator is not liable for losses caused by withdrawal delays or obstacles.

The Operator is not liable for fees applied by the Client’s financial institution.

Winnings cannot be exchanged for cash or alternative prizes.

Clients should seek independent advice on any tax or legal obligations.

6. LIABILITY

The Operator is not responsible for technical issues, server failures, lag, or political disturbances affecting gameplay.

Refunds are only granted at the discretion of management.

Funds obtained through fraud, terms breaches, criminal activity, or manipulation are not claimable by the Client.

The Client acknowledges the Operator is not liable for any direct or indirect loss, including missed opportunities, lost profits, reputational damage, or financial loss.

The Operator disclaims liability for errors (e.g. typos, bugs) and force majeure.

7. RESPONSIBLE USE, ACCOUNT CONTROLS, AND CLOSURE

The Operator is committed to providing its services in a safe, fair, and responsible manner.

Participation in the service is entirely voluntary and undertaken at the Client’s own risk. The Operator makes no guarantees regarding uninterrupted availability or continuous access to the service.

Clients who are subject to any gambling self-exclusion scheme, including those administered by the Estonian Tax and Customs Board, are strictly prohibited from using the service.

Where there are reasonable grounds to suspect gambling-related harm, misuse of the service, or regulatory risk, including the inability to apply customer due diligence measures, the Operator reserves the right to request additional information, impose restrictions, or close a Client’s account.

Clients may request the closure of their account at any time by submitting a written request to the Operator. Where the request is based on concerns relating to gambling addiction or problem gambling, such concerns must be expressly stated at the time of submission.

Once an account has been closed, reactivation is not guaranteed and, where permitted, may only be granted at the sole discretion of the Operator following appropriate review.

Clients may set personal loss limits on a weekly and/or monthly basis. Loss limits take effect immediately upon being set. Limits may be reduced at any time with immediate effect, while any request to increase a limit will only take effect after a mandatory 48-hour cooling-off period.

Accounts that remain inactive for a continuous period of twelve (12) months may be closed by the Operator without further notice.

8. GENERAL RULES

Clients must adhere to all individual game rules alongside these Terms.

Violations render affected games void and winnings forfeit.

The Operator may void games or results if Clients exploit bugs or errors, fail to report issues, or influence outcomes unlawfully.

Each Player Account must be used solely by the account holder. Multiple accounts per person are prohibited and may result in closure and confiscation of funds.

Users are strictly prohibited from accessing the website via Virtual Private Networks (VPNs), proxy services, or any other technology designed to obscure or alter the true geographic location of the user.

The Operator reserves the right to monitor, investigate, and take action where such technologies are detected. This may include temporary suspension, restriction, or permanent closure of the user’s account, and the withholding of any funds or winnings obtained in breach of this clause.

The use of VPNs to circumvent jurisdictional restrictions is considered a material breach of these Terms.

It is the sole responsibility of the user to ensure that use of the Platform is lawful within their country or jurisdiction of residence.

By accessing or using the Platform, users warrant that they are not breaching any applicable local, national, or international laws, including but not limited to restrictions on online gaming, gambling, or digital entertainment services.

The Operator accepts no liability for any breach of law by a user and reserves the right to take appropriate action, including account suspension or closure, should any such breach come to its attention.

9. CHAT FUNCTION RULES

The Operator may offer a chat feature, monitored and recorded for compliance.

Abuse of the chat (e.g. offensive or misleading messages, third-party promotion, conspiracy, illegal activity) will result in suspension or closure.

Chat transcripts must not be shared externally.

10. INTELLECTUAL PROPERTY

All trademarks, logos, product names and slogans related to the service are the Operator’s property and may not be used without prior written consent.

11. AMENDMENTS

The Operator may amend game rules or service terms unilaterally.

Where possible, Clients will be notified via email or on the Platform. Clients are responsible for keeping up to date with such changes.

12. BREACH OF TERMS

If the Client breaches these Terms, the Operator may close their account, withhold winnings, and offset any damages.

13. COMPLAINTS

Clients should submit complaints via chat or by emailing [email protected] and/or [email protected].

The Operator will make reasonable efforts to resolve issues promptly.

Complaints submitted to the Estonian Tax and Customs Board will be investigated without delay.

14. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force.

These Terms are written in English and may be provided in other languages, e.g. Estonian. If there are any discrepancies between the English and the other version, the English version shall prevail.

15. PROHIBITED JURISDICTIONS

The Operator does not permit gameplay, betting, or the use of gambling-related services from the following jurisdictions, whether such access is legal or illegal under local legislation:

16. GOVERNING LAW

These Terms are governed by Estonian law. Disputes will be resolved through negotiations, or in Harju County Court if unsuccessful.
